ACES is TRCC approved! The new warranties and samples went into circulation on September 1st, 2005. These new documents incorporate the changes in performance standards required by the TRCC.
TRCC Registration of Homes: The Essentials
$30 per home or $25 for online enrollments.
Fill out the required one page application found
at trcc.state.tx.us or
call the TRCC at 512-305-TRCC or 877-651-TRCC. The form requests
standard information (such as location, when it was built);
however, instructions for completing this form are also included.
a) Once the transfer of title occurs,
a builder will have up to 15 days following the end of the
month in which the title transferred to register the new
home and submit the required fee. (This is the most common
situation when the builder owns the land the home was built
on and then sells the house.)
b) If the transaction does not involve
a transfer of title, the registration and fee must be sent to the TRCC
within 15 days following the earlier date of when the agreement is
signed or the work commences. (This is the most common situation during
a remodel job or when the builder builds on the customer's lot.)
Yes. Certain interior renovations exceeding $20,000
must be registered submitting the application and $30 fee.
Home registration will be offered over the
internet on the TRCC's website through Texas Online, mail or fax. Texas
Online is an E-pay processing system that allows a builder
to submit the payment and form electronically.
Within thirty (30) days following the registration
of a home, the TRCC is required to mail to the owner of the
registered home information concerning the function of the
TRCC, the provisions of the limited statutory warranty and
building and performance standards, the state-sponsored inspection
and dispute resolution process, and the procedures by which
complaints or requests are filed with the TRCC.
The addendums to your contracts that ACES
provides (such as the Addendum to the Residential Remodeling
Agreement) include language about the state-sponsored process.
In summary, the addendum provides that the ACES dispute resolution
procedure will be the first step in resolving the dispute.
