ACES Improvements Over Existing Builder Insured Warranty Programs

Easy to enroll homes and administer ACES Warranty. Simply provide the buyer a sample at Earnest Money Contract, give the warranty at closing, and send the enrollment form to ACES afterwards.
 
Send absolutely NO INSPECTION FORMS to ACES. Just keep copies in your files.
 
Expect to receive prompt responses from local personnel on warranty and administrative issues. We have reps across the state of Texas.
 
The Residential Construction Liability Act (RCLA) & TRCC are incorporated into the product.
 
The ACES Addendum to the Earnest Money Contract (or Contract for Sale ) gives home owners a chance to review the performance standards before closing.
 
The ACES Warranty and Performance Standards are written to be clearer and more detailed about the responsibilities of each party than any existing product. Homeowner maintenance responsibilities are named throughout the document.
 
The unique Three-Step Dispute Resolution Process:
  1. Administrative Intervention - quick, inexpensive, uncomplicated. Lots of room for parties to find avenues of resolution, but with involvement of non-partisan staff.
     
  2. Non-Binding Mediation - quick, inexpensive, more formal but still affording the parties time and room to negotiate.
     
  3. Binding Arbitration - still quick and inexpensive compared to litigation, but a true decision-maker is involved, whose decision is binding to both parties. An agreement has been reached for AAA to handle all ACES arbitrations.
 
Completely new criteria and procedures for determination of Major Structural Failures. No other program available uses anything like the ACES point system for determining foundation failure. This system was designed by structural engineers, and has been field tested in several markets. Additionally, the system for addressing alleged foundation failures is new, and parallels the Three-Step Dispute Resolution Process for handling disagreements about failures and responsibilities.
 
The ACES Builder Pledge spells out for homeowners the code of ethics the ACES Builder subscribes to. These are promises the builder makes by his participation in the ACES Program.
 
Technical competence and professionalism is exhibited and enhanced by the ACES Builders participation in a required Continuing Education Program.
